The Constitutional Court can:

Decide on complaints against individual decisions that violate human rights

The Court can decide on complaints against individual decisions taken by state bodies, bodies of local and regional self-government and legal persons vested with public authority where such decisions violate human rights and fundamental freedoms, as well as the right to local and regional self-government guaranteed by the Constitution of the Republic of Croatia.

If the Court decides to accept a constitutional complaint, it will repeal the disputed act by which a constitutional right has been violated. The Constitutional Court will state which constitutional right was violated and describe the violation.

Examine your proposal for review of constitutionality and legality of legal provisions

This means that you can submit proposals for review a legal provision if you believe that it violates your human rights because it is contrary to a higher legal provision or the Constitution. 

If the Constitutional Court accepted the proposal and repealed the provision of the law, or the provision of another regulation, you have the right to submit a request to the competent body to change the final individual act whereby your right was violated and which was passed on the basis of the repealed provision. 

The Constitutional Court cannot:

The Constitutional Court can only carry out those tasks which it is allowed to do under the law. It has very specific functions and it does not have the same power to review specific disputes as higher courts in Croatia. Therefore, it cannot:

  • examine complaints about the actions of private companies and persons
  • re-examine the evidence of national court cases
  • punish state officials or private individuals
  • grant compensation to you due to violations of your human rights

Additionally, The Constitutional Court cannot grant you compensation for a violation of your rights. If the court has declared that a certain legal provision has violated your rights, you must apply for compensation in a court of general jurisdiction (civil court) or ask the institution which has applied that provision to revoke its decision and to compensate you.
